Child Custody: Visitation, Parenting Time

“Child Custody-- the legal and practical relationship between a parent and his or her child, such as the right of the parent to make decisions for the child, and the parent's duty to care for the child.”

There are many different forms of child custody, including sole custody, joint custody, and shared parenting. No parent wants to “share” their child, or potentially miss out on fun times, academic achievements, or other accomplishments. Not only do you have to decide where the child will reside, but who makes the decisions for him or her and how those decisions will be made will need to be determined as well. There are several variations to the different custodies mentioned, and a decision might prove to be difficult based on the complexities of the divorce, and the cooperation, or lack of, between you and your spouse. Our expert attorneys are here to support you as you deal with the many challenges of these complex child custody issues.

Child custody proceedings can be very tense and difficult. A clear path is not always visible, and tempers tend to flare. In some cases, a Law Guardian may be appointed by the court to represent the best interest of your child. It is the job of the Law Guardian to communicate with all parties involved and make a recommendation to the court regarding custody and visitation. The Law Guardian is the advocate for your child, just as we are the advocate for you.

Legal matters within a divorce that involve child custody issues can make a case  more challenging, as well as emotionally taxing and stressful. At the Law Offices of Russell I. Marnell, P.C. our dedicated team of experienced lawyers can help you achieve the best possible custody arrangement for you and your child.

We understand that when shared custody, visitation times, and the possible inability to make a quick decision regarding your child gets thrown in the mix, parenting can become much more frustrating, and it can make coming to terms with divorce more difficult.  That is why our attorneys are always focused on the outcome that is best for you.  Our firm believes in working 1:1 with clients to ensure successful management of the entire process, with direct client support from start to finish. Our unique cross-industry expertise, not only within business and law, but finance as well helps insure that all angles of custody are managed to your benefit.

With combined internal bench strength and thorough preparation, our firm has successfully litigated more than 200 trials involving complex custody, equitable distribution, and child support and maintenance issues.

“Whatever it takes” is how we deliver results.  We work and strive for agreements, compromise and settlements, but we stand equipped, prepared and ready for trial litigation to challenge and insure that your rights and the rights of your child are fully protected and that you are awarded all that you deserve from your case.

why marnell law consutation and fees schedule a consultation

As no two people are alike, neither are any two families, or legal matters involving family situations. Financial implications vary. The degree of psychological and emotional trauma may differ. There may be other legal issues and personal ramifications to be considered. Since 1985, the Law Offices of Russell I. Marnell, P.C. has realized this. Concentrating on complex divorce and family law, our firm has litigated many cases to Court decision, including those involving orders of protection, child abuse and neglect.

Most experienced matrimonial attorneys charge a consultation fee. The primary reason we charge a consultation fee is to prevent your spouse from "attorney shopping" i.e. if your spouse were to meet with several top attorneys, you would be precluded from retaining any of the attorneys yourself. This tactic is called "poisoning the well."

Consultations typically last one to two hours during which you will receive our undivided attention.
