Non Complex Divorce

For some couples, the decision to divorce is made with ease as both parties understand that each individual is better apart than when they are together.  It may sound strange, but plenty of marriages terminate amicably, and they do so as the couple involved tends to agree on the outcome. Both husband and wife choose to dissolve the marital partnership, and respect one another enough to equitably divide their marital assets—alleviating the complication and extensive emotional turmoil typically associated with divorce. 

As such, these uncontested, or ‘non-complex’ divorces can be managed swiftly and inexpensively. For example, should a couple maintain few assets, no children, and respectful agreement, the courts are left with little to decide and resolution can typically be managed outside of a courtroom. Couples are able to streamline the paperwork process, while also limiting the amount of information made public.  Some couples even question the need to hire an attorney. In our opinion, the couple should weigh the advantages hiring legal representation as attorneys can assist with document navigation and preparation, while also acting as legal representation in the event that unforeseen circumstances arise. Some of even the most well-intentioned couples begin their divorce proceedings in New York with the desire to keep things amicable and simple—only to have those goals interrupted by disagreements over asset division or custody—leading the proceedings to become more complex.  Should this occur, having legal representation in place would bring comfort as a supportive legal team can negotiate the dissolution of your marital contract as equitably and successfully as you would hope.
